Point being is that you can't compare the 2 punishments because technically they aren't for the same crime.

That maybe true but it's a different discussion to comparing the punishments they both got. A sentence can only be passed on the crime they were found guilty for. Whether we like it or not, Higgins was found not guilty, Lee wasn't
